1. Acceptance of Terms

By accessing and using the Northern Trails Canada website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. These Terms of Service apply to all visitors, users, and others who access or use our tourism services.

Northern Trails Canada reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the service after any such changes shall constitute your consent to such changes.

2. Tour Booking and Payment Terms

All tour bookings are subject to availability and confirmation by Northern Trails Canada. A booking is confirmed only when you receive written confirmation from us via email. Prices are quoted in Canadian Dollars (CAD) and are subject to change without prior notice until booking is confirmed.

Payment terms require a deposit of 25% of the total tour cost at the time of booking, with the full balance due 30 days prior to departure. Failure to make final payment by the due date may result in cancellation of your booking without refund of the deposit. We accept major credit cards, bank transfers, and certified checks as payment methods.

  • Deposits are non-refundable except under specific cancellation policies
  • All prices include applicable taxes unless otherwise stated
  • Additional fees may apply for special dietary requirements or accommodation upgrades
  • Travel insurance is strongly recommended and available for purchase

3. Cancellation and Refund Policy

Cancellations must be made in writing via email to our customer service department. Cancellation fees are based on the number of days prior to departure that we receive your written cancellation notice:

  • More than 60 days before departure: 25% of total tour cost
  • 31-60 days before departure: 50% of total tour cost
  • 15-30 days before departure: 75% of total tour cost
  • 14 days or less before departure: 100% of total tour cost (no refund)

Northern Trails Canada reserves the right to cancel any tour due to insufficient enrollment, extreme weather conditions, or other circumstances beyond our control. In such cases, you will receive a full refund or the option to transfer to an alternative tour of equal value. We are not responsible for any incidental expenses or consequential losses incurred as a result of tour cancellation.

4. Travel Requirements and Participant Obligations

Participants must be in good physical health and able to participate in outdoor activities that may include hiking, walking on uneven terrain, and exposure to varying weather conditions. Any medical conditions, dietary restrictions, or mobility limitations must be disclosed at the time of booking.

All participants must carry valid government-issued photo identification. International travelers must ensure their passport is valid for at least six months beyond their travel dates and must obtain any required visas independently. Northern Trails Canada is not responsible for denied entry due to inadequate documentation.

  • Minimum age requirements apply to certain tours
  • Participants must follow all safety instructions from tour guides
  • Alcohol consumption is prohibited during certain activities
  • Smoking is not permitted on transportation vehicles or in designated non-smoking areas

5. Limitation of Liability

Northern Trails Canada acts only as an agent for the various independent suppliers that provide hotel accommodations, transportation, sightseeing, activities, or other services connected with your tour. Such services are subject to the terms and conditions of those suppliers. Northern Trails Canada and its employees cannot accept responsibility for the acts or omissions of these suppliers.

We strongly recommend that all participants purchase comprehensive travel insurance to cover trip cancellation, medical expenses, emergency evacuation, and personal belongings. Northern Trails Canada's liability is limited to the tour price paid and does not include compensation for indirect or consequential losses.

6. Force Majeure

Northern Trails Canada shall not be liable for any failure to perform its obligations under these terms if such failure results from acts of God, natural disasters, war, terrorism, labor disputes, government regulations, or other circumstances beyond our reasonable control. In such events, we will work with participants to provide suitable alternatives or refunds where possible.

7. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Northern Trails Canada and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Participants grant Northern Trails Canada permission to use photographs or video footage taken during tours for marketing and promotional purposes unless explicitly requested otherwise in writing prior to tour commencement.

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our service. By using our service, you agree to the collection and use of information in accordance with our Privacy Policy, which is incorporated into these Terms of Service by reference.

9. Governing Law

These Terms shall be interpreted and governed by the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration in accordance with the rules of the Alberta Arbitration Act, or in the courts of Alberta, Canada.
